3. Eligibility

You may use our Services only if you are legally capable of entering into a binding contract and using a valid payment method in your own name.

4. Account Registration

7. Consumer and Business Plans

Only Beautifully Written may offer both consumer and business subscription plans.

Subscription plans may include:

Unused credits may roll forward only while a subscription remains active and in good standing.

Subscription pricing and features may change from time to time. Material changes will be communicated to subscribers as required by law.

8. Order Modifications and Cancellations

Customers may edit or cancel an order up until the order enters the handwriting or production queue.

Once an order has entered production, has been handwritten, printed, or mailed, it generally may not be modified or canceled.

The determination of whether an order has entered production shall be made by Only Beautifully Written in its reasonable discretion.

9. Customer Content and Uploaded Materials

Our Services allow customers to upload:

• Messages
• Images
• Logos
• Artwork
• Designs
• Recipient information
• Other content ("Customer Content")

You retain ownership of your Customer Content.

By uploading Customer Content, you grant Only Beautifully Written a limited, non-exclusive, royalty-free license to reproduce, process, display, store, and use such content solely for the purpose of providing the Services and fulfilling orders.

You represent and warrant that:

• You own or have the necessary rights to submit the content;
• The content does not infringe any intellectual property rights;
• The content does not violate any laws or regulations.

Customers may delete certain content from their account portal; however, Only Beautifully Written may retain copies for backup, legal compliance, fraud prevention, order history, business operations, and other legitimate business purposes.

Customers are responsible for maintaining their own backups of important content. Only Beautifully Written does not guarantee permanent storage of customer content.

10. Prohibited Content and Acceptable Use

Only Beautifully Written is committed to providing a respectful and lawful platform. Customers may not use the Services to create, transmit, or distribute content that:

• Violates any federal, state, or local law;
• Infringes upon copyrights, trademarks, or other intellectual property rights;
• Contains hate speech or discriminatory content;
• Promotes violence, harassment, or threats against individuals or groups;
• Contains obscene, pornographic, or sexually explicit material;
• Is defamatory, fraudulent, misleading, or deceptive;
• Impersonates another individual or entity without authorization;

Only Beautifully Written reserves the right, in its sole discretion, to refuse, remove, cancel, or decline any order or content that violates these Terms or that we believe may expose us to legal, reputational, or operational risk.

11. Intellectual Property

The Website, Services, designs, software, logos, trademarks, graphics, text, and other content provided by Only Beautifully Written are owned by or licensed to Only Beautifully Written and are protected under applicable intellectual property laws.

Except as expressly permitted, users may not:

13. Mailing and Delivery

Only Beautifully Written strives to mail orders on or before the selected send date. However, actual delivery times depend on the United States Postal Service ("USPS") and other third-party carriers, over which we have no control.

We do not guarantee delivery dates unless expressly stated in writing.

Once an order has been deposited with USPS or another carrier, risk of loss and delivery delays passes to the carrier.

Only Beautifully Written is not responsible for delays caused by:

• Postal service disruptions;
• Weather events;
• Natural disasters;
• Incorrect addresses provided by customers;
• Government actions;
• Carrier errors or delays.

Customers are responsible for verifying all recipient names and mailing addresses before submitting an order.

14. Pricing and Taxes

Prices displayed on the Website may include or exclude taxes and postage depending on the product or pricing plan selected.

Applicable sales taxes will be calculated based on the delivery destination and applicable law.

Only Beautifully Written reserves the right to correct pricing errors, calculation errors, or typographical mistakes at any time, including after an order has been submitted.

15. Refunds and Satisfaction Guarantee

Only Beautifully Written offers a limited satisfaction guarantee.

Refunds, credits, or replacements may be issued at our discretion when a legitimate service failure has occurred, including situations such as:

• Orders mailed significantly later than promised;
• Cards materially differing from the approved design;
• Handwriting appearing materially inconsistent with the selected style;
• Printing or production defects;
• Incorrect fulfillment caused by Only Beautifully Written.

Refunds will generally not be issued for:

• Customer typos or message errors;
• Incorrect addresses provided by customers;
• Delays caused by USPS or third-party carriers;
• Subjective dissatisfaction without an objective service issue;
• Changes of mind after production has begun.

Claims under our satisfaction guarantee must generally be submitted within 90 days of the order date.

Only Beautifully Written reserves the right to investigate all claims and determine appropriate remedies in its reasonable discretion.

16. Subscription Terms

Consumer and business subscriptions may automatically renew unless canceled.

Subscribers may cancel future renewals at any time through their account portal or by contacting customer support.

Cancellation of a subscription does not entitle customers to refunds for prior billing periods except where required by law.

Subscription benefits, credits, and discounts may expire or terminate upon cancellation of the subscription.

17. Disclaimer of Warranties

THE WEBSITE AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE."

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ONLY BEAUTIFULLY WRITTEN DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND UNINTERRUPTED SERVICE.

We do not guarantee that the Website will always be available, secure, error-free, or free from harmful components.

18. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ONLY BEAUTIFULLY WRITTEN LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO THE USE OF THE WEBSITE OR SERVICES.

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE GREATER OF:

• (a) THE AMOUNT PAID BY YOU TO ONLY BEAUTIFULLY WRITTEN FOR THE APPLICABLE ORDER; OR
• (b) ONE HUNDRED U.S. DOLLARS ($100).

SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS OF LIABILITY, SO SOME OF THESE LIMITATIONS MAY NOT APPLY TO YOU.

19. Privacy Policy

Your use of the Website and Services is also governed by our Privacy Policy, which is incorporated into these Terms by reference. The Privacy Policy explains how we collect, use, store, and protect your information.

By using our Services, you acknowledge that you have reviewed and agreed to our Privacy Policy.

20. Account Suspension and Termination

Arbitration shall:

• Be conducted in English;
• Be heard by a single arbitrator;
• Be governed by California law.

The arbitrator's decision shall be final and binding, and judgment upon the award may be entered in any court of competent jurisdiction.

Nothing in this section prevents either party from seeking temporary injunctive relief or pursuing claims in small claims court where permitted by law.

Class Action Waiver

To the fullest extent permitted by law, you and Only Beautifully Written agree that disputes shall be brought solely on an individual basis and not as part of any class action, consolidated action, or representative proceeding.

24. Governing Law

These Terms and any dispute arising from the Website or Services shall be governed by and construed in accordance with the laws of the State of California, without regard to conflict-of-law principles.

25. Modifications to the Terms

Only Beautifully Written may update or revise these Terms from time to time.
